The general terms and conditions (hereinafter referred to as GTC) apply to all products and services purchased through WUN GMBH – BALLONSHOPZUERICH.CH. This also includes delivery.
The order becomes binding for the buyer once it has been finally submitted. The GTC are deemed to have been accepted upon execution of the order.
The buyer's general terms and conditions of purchase are hereby expressly rejected.
The place of jurisdiction is the registered office of WUN GMBH – BALLONSHOPZUERICH.CH, 8005 Zurich. The contract is subject to Swiss law.

2 – Offer
WUN GMBH – BALLONSHOPZUERICH.CH excludes any liability for the products sold and delivered within the scope of the legally permissible provisions.
All products are not suitable for children under 3 years of age.
The offer from WUN GMBH – BALLONSHOPZUERICH.CH is aimed exclusively at customers with their place of residence or registered office in Switzerland (CHE). Deliveries are made exclusively to addresses in Switzerland and the Principality of Liechtenstein.
All items that can be ordered are available for immediate delivery or can be picked up after ordering online, subject to any stock errors.
The product information on WUN GMBH – BALLONSHOPZUERICH.CH (photos, illustrations, dimensions, weights, etc.) is to be understood as a guide only. This information is usually obtained directly from the manufacturers. Therefore, no liability can be accepted for the accuracy, completeness, and timeliness of the product information. 3 – Prices
The sales prices published on WUN GMBH – BALLONSHOPZUERICH.CH are authoritative. All prices are in Swiss francs (CHF).

4 – Minimum order value
There is no minimum order value. For orders under CHF 15, we charge a small quantity surcharge of CHF 8.

5 – Delivery
Your order will be carefully packaged. Delivery will be made from the warehouse in Zurich via Swiss Post.
Orders will be shipped immediately if possible, but no later than within 24 hours (on business days).
This applies to business days. No shipments are made on Saturdays or Sundays.
All products available for order are immediately deliverable or ready for pickup. Subject to inventory errors.
Dates and delivery times are non-binding unless expressly agreed otherwise in writing. The specification of certain delivery periods and delivery dates by WUN GMBH – BALLONSHOPZUERICH.CH is subject to correct and timely delivery by suppliers and manufacturers.
WUN GMBH – BALLONSHOPZUERICH.CH is entitled to make partial deliveries.

6 – Shipping and pickup costs
Shipping and any pickup costs are listed in the order.
For pickups between 9:00 a.m. and 10:00 a.m. and between 8:00 p.m. and 10:00 p.m., as well as for pickups on Sundays, we charge an additional pickup fee of CHF 5. This surcharge is visible when selecting the time slot during the ordering process.

7 – Transfer of risk
Delivery is made at the recipient's risk.
The goods must be checked for correctness, completeness, and integrity immediately upon arrival. Transport damage must be reported and documented immediately, at the latest two calendar days after receipt of the goods.
The risk is transferred to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible through no fault of WUN GMBH – BALLONSHOPZUERICH.CH, the risk is transferred to the buyer upon notification of readiness for shipment.
Visible quantity discrepancies must be reported to the carrier in writing immediately upon receipt of the goods. Hidden quantity discrepancies must be reported to WUN GMBH – BALLONSHOPZUERICH.CH immediately upon receipt of the shipment. Any further complaints must also be reported immediately.

8 – Terms of payment
When paying with Twint, PostFinance Card, or credit card, the amount will be debited when the order is placed.
For prepayment or bank transfer, delivery will only take place after receipt of payment.
If "Payment on collection" is selected, WUN GMBH – BALLONSHOPZUERICH.CH reserves the right to fill the ordered helium balloons only when the customer is present on site. In this case, the customer must allow for possible waiting times.
A payment is only considered to have been made when WUN GMBH – BALLONSHOPZUERICH.CH has access to the amount.

9 – Retention of title
The delivered goods remain the property of WUN GMBH – BALLONSHOPZUERICH.CH until full payment has been received.
In the event of late payment, WUN GMBH – BALLONSHOPZUERICH.CH is entitled to charge reminder fees and interest on arrears at the standard bank rate.
During the period of default, WUN GMBH – BALLONSHOPZUERICH.CH is also entitled at any time to withdraw from the contract, demand the return of the delivered goods, and claim damages for the termination of the contract.
All claims shall become due immediately if the customer defaults on payment, culpably fails to comply with other essential obligations under the contract, or if WUN GMBH – BALLONSHOPZUERICH.CH becomes aware of circumstances that are likely to reduce the customer's creditworthiness, in particular cessation of payments, pending settlement or bankruptcy proceedings.
In such cases, WUN GMBH – BALLONSHOPZUERICH.CH is entitled to withhold outstanding deliveries or to make them only against advance payment or security.
WUN GMBH – BALLONSHOPZUERICH.CH reserves the right to demand advance payment or payment by credit card.
Claims for damages arising from impossibility of performance, breach of contract, culpa in contrahendo, and tort are excluded against both WUN GMBH – BALLONSHOPZUERICH.CH and our vicarious agents, unless there is evidence of intent or gross negligence.
No liability is accepted for consequential damages resulting from the use of the products.

10 – Returns
Returns of items from WUN GMBH – BALLONSHOPZUERICH.CH are generally not possible.
For returns of defective products, WUN GMBH – BALLONSHOPZUERICH.CH requires that the defective product be returned to WUN GMBH – BALLONSHOPZUERICH.CH, Heinrichstrasse 225, 8005 Zurich, within a maximum of 3-4 days, accompanied by a complete and detailed description of the fault/defect.
A copy of the invoice or delivery note must be enclosed with returns or refunds.
Products that we procure at the customer's request are excluded from return.
WUN GMBH – BALLONSHOPZUERICH.CH does not cover the shipping costs for returns.
